ABOUT A BATH.

CLAIM BY A VESTRY.

In the Magistrate's Court at Masterton yesterday afternoon, before Mr S.L.P. Free, S.M., a case was heard in which Arthur Albert Schofield, secretary of the Tinui Church Vestry, claimed from Rupert Walter Perry, of Tinui, the return of an enamel bath valued at 8 15s, and 5 damages for its detention.

Mr H.E. Hart appeared for the plaintiff, and Mr H R Biss for the defendant.

The evidence for the plaintiff went to show that a few years ago the Rev. B.D. Ashcroft, vicar of Tinui, devoted his Easter offerings to the purchase of a bath and articles of furniture for the vicarage.

He subsequently proceeded on active service.

The vestry of the church purchased the bath and had it installed.

On his return, the Rev. Ashcroft found that the vestry had sold the vicarage to Mr Perry. He resided there until the sale was completed, and when he left, desired to remove the bath, with other articles. Mr Perry refused to allow the bath to be removed, hence the present action.

The defence was that the bath was sold to the defendant with the house, and was a fixture.

After hearing evidence, His Worship ordered that the bath be returned to the plaintiff within fourteen days, in default a payment of 8 15s, with 2 damages, and costs.
